All drivers are under a duty to obey traffic signals, and with good reason. Running a red light can prove disastrous if it causes a serious car accident.

A passenger van collided with an SUV in Los Angeles recently, nearly sending the van containing 13 children and two adults into a 10-foot plunge into the Pacoima Wash. According to the Los Angeles Police Department, the crash sent the van up over a low concrete safety wall and through a fence. The van came to rest with its front two tires hanging over the concrete barrier.

All the occupants aboard the van were safely evacuated, and only one was taken to the hospital with a minor injury. While it appears that at least one of the vehicles may have run a red light causing the accident, the accident is still under investigation.

Fortunately, no one was seriously harmed in this crash. That often isn’t the case. When a person is hurt in an auto accident, that person may seek compensation for their injuries to cover expenses such as hospital bills and ambulance fees. In addition, the victim may be awarded damages for future medical costs if the victim is in need of additional rehabilitative or long-term medical care.

A car crash victim may also receive compensation for pain and suffering caused by the accident. To be awarded damages for pain and suffering, the court will consider a number of factors, including the length of time the victim has been and will continue to be in pain, the type of injury sustained and the severity of the pain. If the accident caused mental anguish or emotional distress, that also may be claimed to recover damages.

One other aspect of this particular accident may be worth exploring. That is whether the van belongs to an organization or business and was being used to bus the children. Commercial vehicle accidents add complexity to injury causing auto accidents. To get a full appreciation of the legal ramifications requires the aid of experienced legal counsel.
