Every day, children fall victim to sexual abuse imposed on them by family members that are charged with their safety and care. A victim of sexual abuse may pursue criminal charges against the perpetrator. However, victims may also bring a suit in a court of law for the injuries and trauma they received at the hands of their abuser.

A California man who sexually molested seven of his female relatives has been sentenced to 30 years in state prison. The victims ranged in age between 5 to ten years old. The man had plead guilty to three counts of committing lewd act on a minor by force. In addition, the man’s wife was also sentenced to 5 years and 8 months in prison after pleading guilty to felony child abuse. The court determined the wife was aware of the sexual assaults, but did nothing to stop them.

Sexual abuse is a very serious crime that could have long-lasting consequences. In addition to criminal charges, someone who sexually abuses another could find themselves the subject of a sexual abuse civil lawsuit. In addition to assault and battery, a victim of sexual abuse may bring a lawsuit for intentional infliction of emotional distress. To prevail in such a claim, it must be shown that the defendant intentionally engaged in extreme or outrageous that caused the victim severe emotional distress. Emotional distress may include feelings of grief, shame, embarrassment or fright.

A victim of sexual abuse may be able to recover for both bodily injury and emotional trauma. By bringing a sexual abuse civil lawsuit, victims of abuse may find some compensation and closure for the harms they suffered.
