Students in the halls and classrooms of their schools assume they will be safe from any harm. So when a student is sexually assaulted by another student, the feeling of safety and security the victim once had could be shattered in an instant. Sometimes, the only way a victim of sexual abuse can find closure is through a sexual abuse civil lawsuit.

In a disturbing incident, an 18-year-old man was arrested after sexually assaulting 17-year-old California girl. Both the abuser and the victim were students at a private continuation high school in North Hills, Los Angeles. According to police, the abuser pulled the victim into a bathroom, where he allegedly assaulted her by kissing her and attempting to undress her. The abuser previously had attempted to flirt with the girl, but she rejected his advances. The assault came to an end when another individual began knocking on the door of the bathroom, allowing the girl to escape. The girl then reported the incident to a teacher, and although she was not physically harmed, she was emotionally shaken. The abuser has been arrested for kidnap with the intent to commit rape.

Victims of sexual assault can suffer severe emotional trauma, even if they are not physically injured. When this happens, some victims may seek compensation through a lawsuit for intentional infliction of emotional distress. To prevail in such a lawsuit, it must be shown that the defendant’s behavior was intentional and outrageous. In fact, the behavior must be so extreme that it crosses every line of human decency. In addition, the plaintiff must have suffered severe emotional trauma. Some ways victims can prove the severity of their distress is via the intensity of the distress, the amount of time the victim suffered the distress and any physical ailments caused by the distress.

When a victim of sexual dispute is seriously harmed either mentally or physically, a sexual abuse civil lawsuit is one way to hold the perpetrators of the assault accountable for their actions. Doing so may also allow victims to experience some form of closure after the incident.
